REGULATIONS FOR CONDUCTING THE GREEN PARTICIPATORY BUDGET IN THE MUNICIPALITY OF STALOWA WOLA
The Green Participatory Budget is a tool supporting civic participation for the residents of Stalowa Wola by providing the opportunity to co-decide on the municipality’s spending on greenery and ecological activities.
General Provisions
§ 1
The Regulations for Conducting the Green Participatory Budget in the Municipality of Stalowa Wola, hereinafter referred to as the Regulations, define the principles and procedures for the implementation of the Green Participatory Budget in the Municipality of Stalowa Wola.
§ 2
Whenever the Regulations refer to:
author – this means the person who submitted a project to the Green Participatory Budget according to the rules and procedures outlined in the Regulations;
co-author – this means the person who, along with the author, submitted a project to the Green Participatory Budget according to the rules and procedures outlined in the Regulations;
Digital Participation Platform – this means the electronic system for participation and administration of the Green Participatory Budget in the Municipality of Stalowa Wola, enabling project submission and publication, announcement of project assessment results, filing appeals, voting, and publishing voting results;
schedule – this refers to the deadlines for conducting various stages of the Green Participatory Budget;
Office – this refers to the City Hall of Stalowa Wola, located at ul. Wolności 7, 37-450 Stalowa Wola.
§ 3
An annual amount of PLN 300,000 is allocated for the implementation of projects selected within the Green Participatory Budget.
§ 4

The process of implementing the Green Participatory Budget consists of the following stages:
project submission;
project assessment;
appeals against the exclusion of projects from voting;
resident voting on projects and determination of the results;
publication of voting results;
implementation of projects selected in the voting.

The deadlines for the stages mentioned in section 1 are determined annually by the Mayor of Stalowa Wola in the form of a schedule, which is announced at least 7 calendar days before the start date of the first stage, and published at least on:
the notice board of the Office;
the website of the Public Information Bulletin of Stalowa Wola – www.bip.stalowawola.pl;
the website of the City of Stalowa Wola – www.stalowawola.pl;
the Digital Participation Platform.
The Mayor of Stalowa Wola appoints, by means of a separate ordinance, a Team for Youth and Green Participatory Budget, responsible for conducting the project selection procedure according to the Regulations.
§ 5
Project submissions are open to residents of the Municipality of Stalowa Wola.

Residents of the Municipality of Stalowa Wola can submit projects:
falling within the scope of the municipality’s own tasks;
-
addressing at least one thematic area from the catalog listed below:
a) planting and maintenance of vegetation in urban green areas, such as:
planting vegetation in parks, green spaces, squares, residential areas, and along streets,
planting new vegetation or supplementing existing vegetation in urban green areas,
establishing and maintaining wildflower meadows and insect-friendly plant beds in urban areas,
maintaining planted vegetation and conserving existing tree stands in urban areas, including natural monuments;
b) new green spaces in urban areas, such as:
public spaces shaped in greenery,
costs for equipment for play and recreation and small architectural elements are allowed, provided that the majority of the planned expenses in the project focus on increasing greenery to counteract climate change;
c) construction of thematic gardens in urban areas, such as:
community gardens,
sensory gardens,
micro-retention facilities – rain gardens, retention basins, retention greenery that manages rainwater from nearby paved surfaces, with a dominant presence of vegetation in the ground or containers, aimed at water infiltration into the soil;
d) renovation and modernization of existing urban green areas, such as actions aimed at improving the state of park, green space, square, street-side green areas, and residential greenery by renovating existing greenery, supplementing plantings, localized repairs of paths and squares, and the renovation or replacement of old small architectural elements;
e) ecological actions, such as educational, cultural, informational, as well as infrastructural or investment activities related to ecology and climate adaptation;
feasible within the budget year;
with a project cost ranging from PLN 10,000 to PLN 100,000;
that will be available to residents of the Municipality of Stalowa Wola free of charge;
indicating recruitment principles, including information on recruitment, start and end dates, and selection criteria – if the project is aimed at a limited group of recipients;
located on properties (land, buildings, premises, etc.) for which the Municipality of Stalowa Wola holds legal title to dispose of.

Within the Green Participatory Budget, residents of the Municipality of Stalowa Wola cannot submit projects that:
involve only the preparation of project documentation;
involve the completion of one component (stage) of the task, which in subsequent years will require further components (stages) to be completed;
are contrary to strategic/program documents for the development of the Municipality of Stalowa Wola;
involve the use of the author's work as defined by the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws of 2022, item 2509, as amended), unless the project includes the transfer of economic or derivative copyrights to the Municipality of Stalowa Wola, and the agreement in this regard is concluded by the day preceding the publication of the project assessment result on the Digital Participation Platform;
specify a potential contractor, method of selection, or trademarks;
contain content commonly regarded as obscene, offensive, vulgar, or socially unacceptable.
§ 6
The Office organizes meetings according to the schedule to support residents in preparing their projects.
§ 7
An author can submit a maximum of 3 projects.
§ 8
A project may be submitted by no more than 6 residents of the Municipality of Stalowa Wola: one author and five co-authors.
§ 9
The project must be submitted within the deadline specified in the schedule.

The deadline is determined by:
the date of submission of the project to the Office – for paper submissions, in accordance with § 10(1);
the date of submission of the project on the Digital Participation Platform – for electronic submissions.
§ 10
Projects may be submitted in the form of:
-
paper, according to the project submission form, which is Appendix No. 1 to the Regulations, by:
a) submitting the project to the Office,
b) sending the project to the Office address with the note “Green Participatory Budget,”
c) submitting the project at the meetings mentioned in § 6;
electronic via the Digital Participation Platform, according to the project submission form available on the platform, which is the electronic version of the project submission form, constituting Appendix No. 1 to the Regulations.
§ 11
Project submission should include at least:
The project name formulated in a way that informs about its content;
The project location; including elements mentioned in § 5 section 2 point 7 (necessary for investment projects);
A brief description of the project;
A detailed project description;
A description of how the principle of public accessibility is met;
Information regarding universal design;
The goal and justification for the project's implementation;

Indication of the project's thematic area:
a) Planting and maintenance of vegetation in urban green areas,
b) New green spaces in urban areas,
c) Construction of thematic gardens in urban areas,
d) Renovation and modernization of existing urban green spaces,
e) Ecological activities;

Indication of potential project beneficiaries:
a) Children,
b) Youth,
c) Adults,
d) Seniors,
e) Families with children,
f) People with disabilities,
g) Others;
Estimated cost of project implementation, including the cost of execution and maintenance in the year of execution;
Estimated cost of operation and maintenance in subsequent years;
Data of the author and co-authors, i.e., first name and surname, PESEL number, residence address, phone number, and email address for contact;
Data of the parent or legal guardian of the minor author or co-author, i.e., first name and surname, phone number, and email address;
Signature of the author and co-authors if applicable (for paper submissions) or electronic approval of the project by the author and co-authors if applicable (for electronic submissions);
For authors or co-authors who are foreigners without PESEL numbers, the PESEL number field is left blank, and the project can be submitted upon presenting a travel document issued by the country of which the author or co-author is a citizen to the City Hall employee designated for contact regarding the Green Participatory Budget;
If the author or co-author is a minor:
a) The project submission form in paper version must also be signed by the parent or legal guardian of the minor,
b) The project submission form submitted electronically must also be approved electronically by the parent or legal guardian of the minor;
The required statements indicated in the project submission form, which is Appendix No. 1 to these Regulations, must be checked.
§ 12
If the project involves using the work indicated by the author, as mentioned in § 5 section 3 point 4, the submission described in § 11 must include the author's consent, and in the case of a minor author, the consent of their parent or legal guardian, for the use of the work for the purposes of the Green Participatory Budget, including consent for its non-commercial publication on the Digital Participation Platform, containing the first name, surname, phone number, email address, and signature (for paper forms) or electronic approval (for forms submitted via the Digital Participation Platform) of the author, and in the case of a minor author, their parent or legal guardian.
In the case of a project submitted via the Digital Participation Platform, the original consent of the author for the use of the work must be kept until the day before the publication of the information about the verification result on the Digital Participation Platform and must be presented upon request.
§ 13
If a project is submitted by the author and co-authors, the author is the contact person for matters concerning the project.
The author may designate another person among the co-authors to be the contact person after the project is submitted. In this case, only the designated person is authorized to handle project matters.
The author and the designated co-author in accordance with sections 1 or 2 have all rights arising from the Regulations.
§ 14
All submitted projects are published on the Digital Participation Platform. Submission of a project to the Green Participatory Budget is equivalent to creating an account for the author/co-authors of the project, allowing management of the project on the Digital Participation Platform. This also applies to projects submitted in paper form. Content mentioned in § 5 section 3 point 6 is not published on the Digital Participation Platform.
§ 15
The author has the right to withdraw the project within the deadline specified in the schedule.
The author informs about the withdrawal of the project via the Digital Participation Platform, by email, or in writing. In the case of written notification, the date of receipt of the information by the office determines whether the deadline has been met.
Chapter 4
Rules for verifying submitted projects
§ 16
The verification of submitted projects consists of two stages.
§ 17

The first stage of project verification includes checking whether:

The project meets formal requirements:
a) The project author has submitted no more than 3 projects to the Green Participatory Budget,
b) The project was submitted within the deadline specified in the schedule, considering the rules indicated in § 9 sections 1 and 2,
c) It was submitted in the form specified in § 10,
d) It was submitted by no more than 6 residents of the Stalowa Wola Municipality,
e) The project submission contains all required elements specified in § 11,
f) The project submission includes the author's consent for the use of the work mentioned in § 12 sections 1 and 2, if required;
The project does not contain content mentioned in § 5 section 3 point 6;

If the project author has submitted more than 3 projects to the Green Participatory Budget, the author is called by email or phone within 5 calendar days from the date of the call, unless the author did not provide a phone number or email address, to select a maximum of 3 of the submitted projects for further assessment. If contact data is missing or the author fails to specify a maximum of 3 projects within the designated time, all projects submitted by that author will be considered to not meet formal requirements.

If the project is submitted:
After the deadline specified in the schedule, considering the rules indicated in § 9 sections 1 and 2,
Or in a form other than specified in § 10,
It will be considered as not meeting formal requirements.

If:
The project was submitted by more than 6 residents of the Stalowa Wola Municipality;
The project submission contains deficiencies or omissions regarding elements mentioned in section 1 point 1 lit. e) and f);
The author is called by email or phone to rectify the deficiencies or omissions within 5 calendar days from the date of the call, unless the author did not provide a phone number or email address.
If the project submission meets the requirements mentioned in section 1 or deficiencies or omissions are rectified within the deadline, the project receives a positive result in the first stage of verification.
If the project submission does not meet the requirements mentioned in section 1 or deficiencies or omissions are not rectified within the deadline, the project receives a negative result in the first stage of verification.
§ 18
A project that receives a positive result in the first stage of verification is subjected to the second stage of verification.

During the second stage of verification, the following is checked:

Compliance of the submitted project with the law by analyzing whether:
a) The project does not violate generally applicable laws, including local regulations,
b) The project falls within the scope of the tasks of the Stalowa Wola Municipality,
c) The Stalowa Wola Municipality has legal title to manage the property where the project will be implemented,
d) There will be no violation of third-party rights, including copyright and related rights;

Technical feasibility of the submitted project by analyzing whether:
a) The project does not violate standards, norms, or technical regulations,
b) The project can be implemented at the indicated location, including whether its implementation does not conflict with ongoing or planned projects (e.g., related to applying for external funding) or projects requested for funding and awaiting competition results,
c) Implementation of the project at the indicated location will not violate the warranty provided to the Stalowa Wola Municipality by the contractor for existing infrastructure,
d) Available market technologies enable the project’s realization,
e) Administrative decisions, permits, authorizations, opinions, or other technical documents are required for the project, and whether obtaining them is feasible and will allow project realization within the budget year;
Whether the analyses mentioned in points 1 and 2 indicate that the project can be implemented within one budget year,
Whether the project is not contrary to documents programming the development of the Stalowa Wola Municipality, not being local legal acts, including strategies, programs, and Multiannual Financial Forecasts regarding included undertakings,
Whether the requirements mentioned in § 5 section 2 points 5-7 have been considered and are feasible,
Whether circumstances mentioned in § 5 section 3 points 1 and 2 exist,
Whether the project includes the indication of a potential contractor, method of selection, or trademarks,
Estimated project costs mentioned in the project submission are checked against the costs of similar projects and current market conditions,
Whether the cost of project implementation, as determined in point 8, fits within the amount mentioned in § 5 section 2 point 4.

§ 19
If the conducted activities mentioned in § 18 indicate that the project cannot be realized, and there is a possibility for changes, proposals for changes are prepared. The proposals for changes, along with justification, are forwarded to the author.
Changes to the project, according to the proposed changes, occur with the author's consent expressed in paper or electronic form within 5 calendar days from the date of the proposal, subject to section 3.
Author’s consent is not required for changes resulting from § 18 section 2 point 8.
§ 20
If during the second stage of verification deficiencies from the first stage are revealed, the project is withdrawn from the second stage for re-verification in the first stage. After its completion, the project that receives a positive result is subjected to verification in the second stage.
§ 21
If the project involves using the work indicated by the author under the Act of February 4, 1994, on Copyright and Related Rights, by the day before the publication of information about the project's verification result on the Digital Participation Platform, an agreement must be concluded transferring the author's economic rights or related rights to the Stalowa Wola Municipality, if the project is selected for implementation.
§ 22
A project receives a negative result in the second stage of verification if at least one of the following circumstances occurs:
The conducted activities mentioned in § 18 indicate that the project cannot be implemented;
The author did not consent to the proposed changes within the deadline mentioned in § 19 section 2;
An agreement to transfer the economic rights or related rights to the Stalowa Wola Municipality was not concluded, as mentioned in § 21.
§ 23
If none of the circumstances mentioned in § 22 occur, the project receives a positive result in the second stage of verification.
§ 24
The result of project verification consists of the results from the first and second stages of verification.
A project that receives a positive result in both the first and second stages of verification is considered positively verified.
A project that receives a negative result in either the first or second stage of verification is considered negatively verified.
§ 25
A negatively verified project is not admitted to voting.
§ 26

Information about the project's verification result is:
Published on the Digital Participation Platform within the deadline specified in the schedule;
Communicated to the author by phone or email immediately after it is published on the Digital Participation Platform.
Information about a negative verification result is provided to the author along with an explanation.
§ 27
The author has the right to appeal the negative verification result to the President of the City of Stalowa Wola.
§ 28
The appeal must include:
The name of the appellant;
The project name;
The objections to the project verification along with justification;
The signature of the appellant (for paper appeals) or electronic approval (for electronic appeals).
§ 29
The author may submit an appeal within the deadline specified in the schedule.

The appeal may be submitted in:
Paper form to the office;
Electronic form via the Digital Participation Platform.
-
The deadline is determined by:
The date of receipt of the appeal at the office;
The date of submission via the Digital Participation Platform.
Appeals submitted contrary to sections 1 and 2 will not be considered.
§ 30
Appeals are reviewed within the deadline specified in the schedule.
§ 31
In the case of an appeal that is subject to review, the project is re-verified.
During re-verification, activities previously carried out and not related to the objections are not repeated.
Re-verification focuses on the issues raised by the appellant.
Re-verification can cover both the first and second stages of evaluation.
If the objection pertains to the first stage of verification and is deemed valid, the second stage of verification is conducted.
During the appeal review stage, there is no obligation to contact the author.
§ 32

As a result of reviewing the appeal:
The negative verification result may be upheld;
Or the verification result may be changed to positive.
A decision to uphold the negative result is final, and no further appeals can be made.
§ 33
Information about the result of the appeal review is published on the Digital Participation Platform and communicated to the author by phone or email within the deadline specified in the schedule.
Chapter 6
Voting Procedures, Determining Voting Results, and Publicizing Results
§ 34
Projects that receive a positive verification result are eligible for voting.
§ 35
The order of projects on the voting lists is determined by random draw conducted automatically by the Digital Participation Platform.
§ 36
Voting on projects takes place within the deadline specified in the schedule.
§ 37
Voting is electronic and conducted via the Digital Participation Platform.
§ 38
Eligible voters are residents of the Stalowa Wola Municipality. Voting is personal, and each resident may vote only once.
§ 39
Voting is anonymous; information on how individuals voted is not published.
§ 40
Voting involves selecting any number of projects from the list, with the total cost of selected projects not exceeding the amount specified in § 3.
Each project selected in accordance with section 1 receives one vote.
§ 41
Residents of the Stalowa Wola Municipality vote using an electronic ballot containing at least their name, address, PESEL number, phone number, and email address.
A vote by a minor is confirmed by their parent or legal guardian by providing their details, including at least their name, phone number, and email address, and then electronically confirming the minor's vote.
For foreign residents without PESEL numbers, the PESEL number field is left blank, and voting is possible upon presenting a travel document issued by the country of which the voter is a citizen to the designated City Hall employee.
The electronic ballot template is specified in Appendix No. 2 to the Regulations.
Based on the electronic ballot template mentioned in section 4, an electronic ballot is prepared annually containing the list of projects eligible for voting.
§ 42
Data on the electronic ballot is verified based on information from the Central Repository of Population Records (CRBDEL).
§ 43
After the voting concludes, each project is assigned the number of valid votes it received.

A vote is considered valid if:
It was cast by a resident of the Stalowa Wola Municipality;
It was cast within the voting period specified in the schedule;
At least one project was selected on the electronic ballot;
The electronic ballot contains all the data specified in § 41(1);
The total value of the selected projects does not exceed the amount specified in § 3.
If a resident of the Stalowa Wola Municipality votes more than once, all of their votes are invalid.
§ 44
Based on the valid votes cast, a list of projects is created, ordered by the number of votes received.
§ 45
Projects selected for implementation within the Green Participatory Budget are those that received the highest number of votes until the total budget allocated for the implementation of projects, as specified in § 3, is exhausted.
If the remaining funds are insufficient to implement the next project on the list, the project occupying the next position on the list is selected if its implementation cost fits within the remaining amount, considering §§ 3 and 4.
If multiple projects receive the same number of votes and the remaining funds are insufficient to implement all of them, projects are selected through a random draw conducted automatically by the Digital Participation Platform.

If multiple selected projects are located at the same site and their simultaneous implementation is not possible, the project selected is:
The one highest on the list mentioned in § 44;
Or, if projects have received the same number of votes, the one chosen through a random draw conducted by the Digital Participation Platform.
§ 46

The voting results, including information about selected projects, are made public by posting them on:
The notice board of the City Hall;
The Public Information Bulletin website of Stalowa Wola – www.bip.stalowawola.pl;
The City of Stalowa Wola website – www.stalowawola.pl;
The Digital Participation Platform,
within the deadline specified in the schedule.
Information about the selection of a project is sent to the author by email or phone within 5 calendar days from the public announcement of the voting results on the Digital Participation Platform.
§ 47
The implementation process of the Green Participatory Budget is subject to monitoring and evaluation.
Monitoring involves at least ongoing verification of the implementation process of the Green Participatory Budget, identifying issues, observed difficulties, and checked solutions, including direct conversations with potential project authors during meetings specified in § 6.
Evaluation is conducted annually after the project selection process for the Green Participatory Budget, as described in the Regulations, and involves analyzing the outcomes of this process to make possible improvements for future editions of the Green Participatory Budget. Evaluation is conducted at least through a survey among the authors of submitted projects.
§ 48
Projects selected for implementation within the Green Participatory Budget are entered into the financial plan for the calendar year specified in the schedule.
§ 49
During project implementation, the City Hall contacts the author and provides information about the project's status.
The status of projects is regularly updated on the City Hall website or the Digital Participation Platform.
§ 50
Submitting a project to the Green Participatory Budget, whether in paper or electronic form, implies consent to publicize its content on the Digital Participation Platform, the electronic system for managing the Green Participatory Budget.

Personal data processing for the Green Participatory Budget is carried out in accordance with the following GDPR clause:
GDPR CLAUSE

According to Article 13 of the Regulation (EU) 2016/679 of the European Parliament and Council of April 27, 2016, on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (GDPR) – The Municipality of Stalowa Wola informs that:
The data controller is the MUNICIPALITY OF STALOWA WOLA, based at ul. Wolności 7, Stalowa Wola, hereinafter referred to as the "Controller".
The Data Protection Officer can be contacted via email at iod@stalowawola.pl or by traditional mail at ul. Wolności 7, 37-450 Stalowa Wola, with the note "To the Data Protection Officer."

The Controller processes your personal data for:
a) The implementation of the Green Participatory Budget, providing information related to project evaluation, project amendments, and progress if selected for implementation; monitoring, evaluating activities related to the Green Participatory Budget, and the procedure for implementing the Green Participatory Budget (based on Art. 6(1)(c), (e), (f) GDPR);
b) Receiving information by email or phone about the evaluation of the Green Participatory Budget and its execution, for informational and contact purposes (based on Art. 6(1)(a) GDPR – your consent);
c) Disseminating information about the authors and/or co-authors of the project (based on Art. 6(1)(a) GDPR – your consent).

The Controller processes your personal data based on applicable legal provisions and agreements between the Kingdom of Norway and the European Union (details below), including:
a) The Act of March 8, 1990, on municipal self-government (particularly Art. 5a);
b) Regulation (EU) 2016/679 of April 27, 2016, on the protection of natural persons concerning the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR);
c) The agreement between the Kingdom of Norway and the European Union on the Norwegian Financial Mechanism 2014-2021 and the Memorandum of Understanding on the implementation of the Norwegian Financial Mechanism 2014-2021 and regulations on the implementation of the Norwegian Financial Mechanism 2014-2021;
d) The Act of May 10, 2018, on personal data protection;
e) The Act of February 4, 1994, on copyright and related rights;
f) The Act of April 23, 1964, Civil Code;
g) The Act of August 27, 2009, on public finances;
h) The Act of July 14, 1983, on the National Archive Resource and Archives.

Your personal data may be shared with:
a) Entities providing services to the Controller – e.g., IT service providers, hosting companies.
b) The Ministry of Finance, and entities involved in the Norwegian Funds implementation.
c) Entities performing project monitoring/audit tasks, such as: Program Operator - Ministry of Funds and Regional Policy, National Contact Point, Certifying Authority, NMSZ - Norwegian Ministry of Foreign Affairs, Auditing Institution, performed by the Department of Public Funds Audit at the Ministry of Finance, Norwegian Auditor General's Office or authorized units acting on behalf of these entities.
d) Public authorities and entities performing public tasks or acting on behalf of public authorities, within the scope and purposes specified by applicable law.
e) Other entities authorized by law.
Your personal data will not be subject to profiling.
Your personal data will not be transferred to a third country or international organization.
Decisions based on your personal data will not be made by automated means, in accordance with Article 22 GDPR.
Your personal data will be stored for the duration of the Project and then for at least 5 years from the date of acceptance of the final report for the Local Development Program by the Financial Mechanism Committee and the Norwegian Ministry of Foreign Affairs.
You have:
a) The right of access to your personal data under Article 15 GDPR;
b) The right to rectification or completion of your personal data under Article 16 GDPR;
c) The right to request restriction of processing of personal data under Article 18 GDPR;
d) The right to deletion of data – available under the conditions specified in Article 17 GDPR, i.e., deletion is not possible if necessary for:
Compliance with a legal obligation where the mandatory storage period has not expired,
Performing a task carried out in the public interest or in the exercise of official authority vested in the Controller;
Archiving purposes in the public interest.
e) The right to data portability – available under the conditions specified in Article 20 GDPR (within this action – for data processed based on consent);
f) The right to object to processing – available under the conditions specified in Article 21 GDPR;
g) The right to lodge a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates GDPR provisions;
h) The right to withdraw consent for data processing, which can be withdrawn at any time. Withdrawal of consent does not affect the lawfulness of processing carried out based on consent before its withdrawal (applies only to data processed based on consent).
Providing data is voluntary but necessary for the purposes of processing personal data as mentioned above. Failure to provide data means the inability to participate in the project submission and voting process within the Green Participatory Budget. The publication of the author's and co-authors' names is voluntary (the submitted project may be published anonymously), and consent to receive information about the evaluation is not required for participation in the process.
